Terms & Conditions

These Terms and Conditions govern the hire of vehicles by Orion Prestige Hire Ltd (“Orion”, “we” or “us”) to the hirer named in Schedule 1 (“you” or “the hirer”). By signing this agreement you confirm that you have read, understood and agree to be bound by these terms in their entirety.

Note: References to “Schedule 1” refer to the individual hire agreement issued to you at the time of booking, which sets out vehicle-specific details, hire charges, damage excess, security deposit amount, mileage allowance and other particulars specific to your hire.

1. Definitions

In this agreement: “Vehicle” means the vehicle described in Schedule 1. “Hire Period” means the period from the start to the end date and time specified in Schedule 1. “Hire Charges” means the charges set out in Schedule 1. “Damage Excess” means the amount specified in Schedule 1 you are liable to pay in respect of damage during the Hire Period. “Security Deposit” means the sum held by Orion as security against damage, additional charges or breach of this agreement. “BVRLA” means the British Vehicle Rental and Leasing Association. “Telematics System” means the GeckoTrack Pro Thatcham Category 5 certified device fitted to the Vehicle.

2. Eligibility

To be eligible to hire a Vehicle you must satisfy all of the following at the time of booking and throughout the Hire Period:

  • (a) Hold a full valid driving licence (UK, EU or other jurisdiction acceptable to Orion) for the class of Vehicle hired.
  • (b) Have held your licence for the minimum period: 2 years (Standard Prestige); 3 years (Performance and Ultra Luxury); 5 years (Supercars).
  • (c) Be a minimum of 25 years of age for Standard Prestige, Performance and Ultra Luxury vehicles; minimum 28 for Supercars.
  • (d) Hold no more than 6 penalty points (Standard Prestige); no more than 3 points (Performance/Ultra Luxury); zero points (Supercars).
  • (e) Hold no IN (insurance) or DR (drink/drug driving) endorsements within the preceding 5 years.
  • (f) Have had no more than one fault claim in the preceding 3 years (Standard Prestige); no fault claims in 3 years (Performance/Ultra Luxury); no fault claims in 5 years (Supercars).
  • (g) Be resident in the UK and hold a verifiable UK or EU address.

Orion reserves the absolute right to decline any hire at its sole discretion.

3. Booking and Payment

  • (a) A booking is confirmed only upon receipt of a non-refundable 50% deposit of the total hire charge including VAT.
  • (b) The balance is due no later than 48 hours before the hire start date.
  • (c) The full Security Deposit must be paid by card at or before vehicle handover. The Vehicle will not be released until received in full.
  • (d) All payments must be by credit or debit card in the name of the hirer. Cash is not accepted.
  • (e) All hire charges are subject to VAT at the prevailing rate.
  • (f) You authorise Orion to charge any card provided for all amounts due including charges arising after return of the Vehicle.

4. Cancellation Policy

  • (a) 7+ days’ written notice: full deposit refund within 5 working days.
  • (b) 3–7 days’ notice: charge of 25% of the total hire charge.
  • (c) Less than 72 hours’ notice or failure to collect: charge of 50% of the total hire charge.
  • (d) Orion may cancel at any time where the hire presents an unacceptable risk. A full refund will be issued.

5. Security Deposit

  • (a) Held throughout the Hire Period and up to 5 working days after return to allow for full post-hire inspection.
  • (b) Returned in full within 5 working days provided the Vehicle is returned in the same condition, fuel restored and no excess mileage outstanding.
  • (c) Orion may deduct: damage repair costs; excess mileage; late return charges; fuel shortfall; cleaning costs; administration charges for contraventions; and any other amounts due.
  • (d) If deductions exceed the Security Deposit you remain personally liable for the outstanding balance.

6. Your Obligations During the Hire Period

During the Hire Period you must:

  • (a) Drive carefully, lawfully and in accordance with all applicable road traffic legislation.
  • (b) Ensure the Vehicle is driven only by yourself and any additional drivers named in Schedule 1.
  • (c) Ensure all drivers are fit to drive and not under the influence of alcohol, drugs or impairing medication.
  • (d) Use only the correct fuel type. You are solely liable for all misfuelling costs.
  • (e) Maintain adequate tyre pressures and fluid levels as instructed at handover.
  • (f) Keep the Vehicle locked and secured when unattended.
  • (g) Not take the Vehicle outside the United Kingdom without Orion’s prior written consent.
  • (h) Not use the Vehicle for motor sport, racing, track use, time trial or any test of speed.
  • (i) Not use the Vehicle for hire and reward, taxi or any paid transportation service.
  • (j) Not use the Vehicle for towing or propelling any other vehicle or load.
  • (k) Not carry more passengers than the Vehicle is designed to carry.
  • (l) Not transport any illegal substances, controlled drugs or hazardous materials.
  • (m) Not modify or attempt to repair the Vehicle without Orion’s prior written consent.
  • (n) Comply with all traffic regulations. You are solely responsible for all fines and penalties incurred.
  • (o) Acknowledge that the Vehicle is monitored by the GeckoTrack Pro Telematics System at all times.
  • (p) Not take the Vehicle to any racetrack, airfield, port or ferry terminal. These locations are geofenced.
  • (q) Not connect any device to the Vehicle’s OBD-II or other diagnostic port.
  • (r) Not attempt to disable, tamper with or interfere with the GeckoTrack Pro Telematics System. Any attempt constitutes a material breach of this agreement.

7. Mileage

  • (a) Daily allowance: 150 miles per hire day.
  • (b) Excess mileage: £1.00/mile (Standard Prestige); £2.00/mile (Performance/Ultra Luxury); £3.00/mile (Supercars).
  • (c) In any discrepancy between odometer and telematics data the higher figure will apply.

8. Fuel Policy

  • (a) The Vehicle is provided with a full tank of fuel.
  • (b) You must return the Vehicle with the same fuel level.
  • (c) A fuel shortfall will be charged at the prevailing rate plus an administration fee of £25 + VAT.

9. Smoking Policy

Smoking, including e-cigarettes and vaping, is strictly prohibited in the Vehicle at all times. A professional valet charge of not less than £250 + VAT will apply if specialist odour or residue treatment is required.

10. Late Return

  • (a) The Vehicle must be returned by the hire end date and time in Schedule 1.
  • (b) Extensions must be agreed in writing at least 24 hours before the scheduled return time.
  • (c) Late return without prior agreement: £100 per hour or part thereof.
  • (d) If not returned within 24 hours of the agreed time, Orion may recover the Vehicle via GeckoTrack Pro. All recovery costs are payable by you.

11. Vehicle Inspections and Damage

  • (a) A full photographic inspection is completed before handover. You will have the opportunity to review and note any existing damage.
  • (b) By signing the handover documentation you confirm the Vehicle condition matches the inspection record.
  • (c) You are liable for all damage during the Hire Period not recorded in the pre-hire inspection, up to the Damage Excess in Schedule 1.
  • (d) You must notify Orion immediately of any incident regardless of fault or severity.
  • (e) You must not admit liability to any third party in connection with any incident.
  • (f) Orion reserves the right to have damage repaired by a marque-approved specialist repairer.

12. Accidents and Incidents

  • (a) In the event of an accident you must immediately: (i) ensure the safety of all persons involved; (ii) call 999 if there are injuries; (iii) exchange details with any other party; (iv) take photographs; (v) obtain witness details; (vi) not admit liability; (vii) contact Orion immediately on the emergency number in your hire pack.
  • (b) You must complete Orion’s accident report form within 24 hours of any incident.
  • (c) Any legal document relating to an incident must be forwarded to Orion within 48 hours of receipt.

13. Breakdown

  • (a) Move to safety where possible; switch on hazard lights; contact Orion immediately. Do not contact any third party recovery service directly.
  • (b) You must not authorise any third party repairs without Orion’s prior written consent.
  • (c) If a breakdown is caused by misuse or any breach of this agreement, you are liable for all recovery and repair costs.

14. Insurance

  • (a) The Vehicle is insured under Orion’s fleet policy for the Hire Period, subject to your full compliance with this agreement.
  • (b) Any breach may render insurance cover void. You will then be personally liable for all losses including the full replacement value of the Vehicle.
  • (c) You must not make any admission to any insurer without Orion’s prior written consent.

15. Delivery and Collection

  • (a) Where requested, the Vehicle will be transported by enclosed trailer at the charge specified in Schedule 1.
  • (b) Risk in the Vehicle remains with Orion until the pre-hire inspection is signed at the delivery address.
  • (c) A waiting charge of £100 per hour applies if the Vehicle is not available at the agreed address and time on collection.

16. Traffic and Parking Contraventions

You are solely responsible for all parking charges, penalty notices, congestion charges, ULEZ charges, toll charges and speeding fines incurred during the Hire Period. An administration fee of £35 + VAT per notice will be charged for processing.

17. Telematics Monitoring and Geofencing

  • (a) The Vehicle is fitted with a GeckoTrack Pro Telematics System (Thatcham Category 5) providing real-time GPS, speed monitoring, mileage recording, crash detection and remote immobilisation.
  • (b) By signing this agreement you consent to continuous monitoring throughout the Hire Period.
  • (c) All UK motor racing circuits, airfields, ports, ferry terminals and Channel Tunnel approaches are geofenced. Entry triggers an immediate alert and may result in remote immobilisation.
  • (d) Persistent or extreme speed threshold breaches may result in remote immobilisation at Orion’s sole discretion.
  • (e) Telematics data may be used as evidence in any dispute.

18. Personal Effects

Orion accepts no liability for personal effects left in the Vehicle. Items found after return will be held for 30 days and may be collected from our premises. Items not claimed within 30 days will be disposed of.

19. Media and Commercial Use

The Vehicle must not be used in any film, television, advertising, commercial photographic shoot or sponsored social media content without Orion’s prior written consent and execution of a separate media hire agreement.

20. Sub-letting and Unauthorised Use

You must not sub-let, lend or make the Vehicle available to any person not named as an additional driver in Schedule 1. Any unauthorised use constitutes a serious breach, voids insurance cover, and results in personal liability for all consequences.

21. Right of Inspection and Recovery

  • (a) Orion may inspect or recover the Vehicle at any time where a GeckoTrack Pro alert indicates a potential breach, without prior notice.
  • (b) All recovery costs arising from your breach are payable by you in full.
  • (c) Orion may terminate this agreement and recover the Vehicle immediately without notice if you breach any term, the Vehicle enters a geofenced zone, or Orion reasonably believes the Vehicle is being used for an illegal purpose.

22. Hirer’s Indemnity

You shall indemnify and hold harmless Orion Prestige Hire Ltd, its directors, employees and agents from and against all claims, losses, damages, costs and expenses arising from: (a) any breach of this agreement; (b) your negligent or unlawful use of the Vehicle; (c) any damage to third party property or personal injury from your use of the Vehicle; (d) any fines or penalties incurred during the Hire Period.

23. Limitation of Liability

  • (a) Orion’s liability shall not exceed the total hire charges paid by you for the relevant hire period.
  • (b) Orion shall not be liable for any indirect, consequential or economic loss arising from the hire.
  • (c) Nothing in this agreement limits liability for death or personal injury caused by negligence.

24. Notification of Change in Circumstances

You must notify Orion immediately if during the Hire Period your licence is suspended or endorsed, you are involved in any road traffic accident, you are arrested, any medical condition arises affecting your ability to drive, or any other circumstance arises that would have affected our decision to hire the Vehicle to you.

25. Fair Wear and Tear

You are not liable for fair wear and tear during normal use. Assessed by reference to the BVRLA Fair Wear and Tear Guide. A copy is available on request.

26. Data Protection

Orion processes your personal data in accordance with the UK GDPR and the Data Protection Act 2018. Full Privacy Notice available at orionprestige.co.uk/privacy-policy. Where required, Orion may share data with the DVLA, police, insurers, credit reference agencies and the BVRLA.

27. Late Payment

Overdue amounts accrue interest at 8% per annum above the Bank of England base rate, calculated daily, pursuant to the Late Payment of Commercial Debts (Interest) Act 1998.

28. Force Majeure

Orion shall not be liable for failure to fulfil obligations caused by circumstances beyond its reasonable control. Orion’s liability in such circumstances is limited to a full refund of all hire charges paid.

29. Severability

If any provision is found invalid or unenforceable, that provision shall be deemed deleted and the remaining provisions continue in full force.

30. Third Party Rights

A person not party to this agreement has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term.

31. Governing Law and Jurisdiction

This agreement is governed by the law of England and Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.

32. Entire Agreement

This agreement constitutes the entire agreement between the parties and supersedes all prior agreements. No variation is effective unless made in writing and signed by both parties.

These Terms and Conditions of Hire are issued by Orion Prestige Hire Ltd in accordance with BVRLA membership requirements.
